PENYALURAN PUPUK BERSUBSIDI DI KABUPATEN BONDOWOSO DALAM PERSPEKTIF HUKUM EKONOMI SYARIAH

Abstract
Subsidized fertilizer distribution is a series of fertilizer distribution activities in Bondowoso with established regulations, such as regulations regarding farmer cards and RDKK for farmer groups, while distributors and retailers are required to have SPJB, SIUP and TDR. The reality on the ground is that problems often occur in the distribution of subsidized fertilizer in Bondowoso. The first research focus, how is the distribution of subsidized fertilizer in Bondowoso district from the perspective of sharia economic law? Second, what is the allocation of subsidized fertilizer in Bondowoso district from the perspective of sharia economic law? The research method used is a sharia economic law research method that adopts qualitative research. The results of the research, in the process of distributing subsidized fertilizer, it was found that there were sales of subsidized fertilizer above the HET and sales using a package model, both of which, according to the perspective of sharia economic law, are not permitted, because they violate the Bai' rules. Second, the subsidized fertilizer allocation process found irregularities and injustice, both of which are not justified from the perspective of sharia economic law.

Abstrak
Penyaluran pupuk bersubsidi adalah rangkaian kegiatan distribusi pupuk di Bondowoso dengan aturan yang telah di tetapkan, seperti aturan tentang kartu tani dan RDKK untuk kelompok tani, sedangkan bagi distributor dan pengecer wajib memiliki SPJB, SIUP serta TDR. Kenyataan di lapangan sering terjadi permasalahan dalam penyaluran pupuk bersubsidi di Bondowoso. Fokus Penelitian pertama, bagaimana Penyaluran pupuk bersubsidi di kabupaten Bondowoso dalam perspektif hukum ekonomi syari’ah? Kedua, bagaimana alokasi pupuk bersubsidi di kabupaten bondowoso dalam perspektif hukum ekonomi syari’ah?. Metode penelitian yang digunakan adalah metode penelitian hukum ekonomi syari’ah yang mengadopsi penelitian kualitatif. Hasil Penelitian, dalam proses penyaluran pupuk bersubsidi di temukan ada penjualan pupuk bersubsidi di atas HET dan penjualan dengan model paketan, kedua hal tersebut menurut perspektif hukum ekonomi syari’ah tidak di benarkan, karena menyalahi aturan Bai’. Kedua, proses alokasi pupuk bersubsidi di temukan ada penyimpangan dan ketidak-adilan, kedua hal tersebut tidak dibenarkan dalam perspektif hukum ekonomi syariah.
