Abstract

Abstract
This study discusses the cooperation between PT. Perumahan Anggrek, Bank BTN, and customers in the Home Ownership Credit (KPR) product in Situbondo from the perspective of Islamic economic law. The research uses a qualitative method with a descriptive-prescriptive approach and is conducted through direct field observation. The findings indicate that the KPR practice involves several contracts, including bay’ taqsit (installment sale) and ijarah muntahiyah bi al-tamlik (lease-to-own contract). In this scheme, Bank BTN purchases the house from the developer, and the customer pays in installments to the bank. The house may be occupied even before the installments are fully paid, while the property certificate is held by the bank as collateral. The lack of clarity in the contract at the beginning of the transaction is a primary issue; however, overall, the practice aligns with the principles of Islamic economic law. The ijarah muntahiyah bi al-tamlik contract is considered the most appropriate, as it involves lease-to-own elements, transfer of ownership, and a clear tripartite cooperation structure.

Abstrak
Penelitian ini membahas praktik kerja sama antara PT. Perumahan Anggrek, Bank BTN, dan nasabah dalam produk Kredit Pemilikan Rumah (KPR) di Situbondo dari perspektif hukum ekonomi syariah. Penelitian ini menggunakan metode kualitatif dengan pendekatan deskriptif-preskriptif dan dilakukan melalui observasi langsung di lapangan. Hasil penelitian menunjukkan bahwa praktik KPR ini melibatkan beberapa akad, di antaranya jual beli taqsit dan akad ijarah muntahiyah bi altamlik. Dalam skema ini, Bank BTN membeli rumah dari pengembang, lalu nasabah mencicil kepada bank dengan rumah dapat ditempati meski cicilan belum lunas, sementara sertifikat ditahan bank sebagai jaminan. Ketidakjelasan akad sejak awal transaksi menjadi isu utama, namun secara umum praktik ini sesuai dengan prinsip-prinsip hukum ekonomi syariah. Akad ijarah muntahiyah bi al-tamlik dianggap paling sesuai karena melibatkan unsur sewa beli, pemindahan hak milik, dan kejelasan struktur kerja sama tiga pihak.
