PERSPEKTIF HUKUM ISLAM TERHADAP CASH ON DELIVERY PADA E-COMMERCE

Over time, e-commerce has developed very rapidly in terms of innovative buying and selling transactions, one of which is the online buying and selling transaction model with a COD payment system. This transaction model invites several views from scholars regarding the validity of the transaction. Therefore, it is necessary to observe in more depth regarding its legal status, remembering that in buying and selling, the object of the sale and purchase (المبيع (must at least be clearly visible first in the muamalah fiqh law and in statutory regulations. To answer the problems in this research, the researcher used a research method with a descriptive type of library research. The data collection technique in this research uses document collection. Then the data obtained was analyzed using data verification. Based on the results of the discussion, buying and selling using the COD payment system is permissible in the view of Islamic law.

Abstrak

Seiring berjalannya waktu e-commerce menjadi berkembang sangat pesat dalam hal inovatif transaksi jual beli, salah satunya adalah model transaksi jual beli online dengan sistem pembayaran COD. Model transaksi ini mengundang beberapa ikhtilaf ulama terkait keabsahan transaksi tersebut. oleh karena itu, perlu diobservasi lebih mendalam mengenai status keabsahannya, mengingat bahwa dalam jual beli, objek jual beli (المبيع (setidaknya harus terlihat jelas terlebih dahulu dalam hukum fikih muamalah maupun dalam peraturan perundang-undanga. Untuk menjawab problem yang ada dalam penelitian ini, peneliti menggunakan metode penelitian dengan jenis penelitian library research yang bersifat diskriptif. Teknik pengumpulan data dalam penelitian ini menggunakan pengumpulan dokumen. Kemudian data-data yang diperoleh dianalisis dengan menggunakan verifikasi data. Berdasarkan hasil diskusi, jual beli dengan sistem pembayaran COD dalam pandangan hukum islam adalah diperbolehkan.
